MEDIATION

As a private mediator, parties can be assisted to reach a solution for a dispute, through mediation. The parties to a dispute must agree that they want to mediate and have to agree on a specific mediator.

The AFSA Secretariat can be contacted for the appointment of a mediator or should the parties agree on our service, we can be contacted directly.

Both parties to a dispute have to agree on mediation ensuring their commitment to the mediation process.


DIVORCE MEDIATION

As divorce mediator parties in a divorce are assisted to reach a Memorandum of Understanding regarding children (if any), maintenance, assets and debts.  Memorandum of Understanding will be drawn up and parties can take this to their legal advisors to be drafted as an agreement which can then be handed in at the divorce court / high court.  This process will be in line with Section 33 (2) of the new Children’s Act, Act 38 of 2005.

This office aims to provide the divorcing parties with a quicker, more efficient and less strenuous divorce process, through divorce mediation.

DIVORCE MEDIATION
